Terms of use

Landscaping Marketplace is part of the NearMe network and runs Australian classifieds for landscape supply and equipment, wanted ads, and the landscapers and contractors who install it. Creating an account or using the site means you accept these terms.

The marketplace is a venue

Sellers write the ads and buyers deal with them directly. We do not own the goods, inspect them, hold anyone's money, build a wall or certify that a product, a machine or installation work is safe, compatible, licensed or compliant. Satisfy yourself about the item, the seller and the work before you pay; the safety guide sets out the checks that matter, starting with retaining walls and buried services.

Accounts and seller identity

You need an account to list or message sellers. Keep your login secure and provide accurate details. A business seller who displays a trading name must be entitled to use the supplied ABN. Account setup checks format and duplicate use; it is not an independent ABR, licence or ownership verification. We may suspend or close accounts that break these terms or the listing rules.

Listings, services and safety claims

State the brand, model, condition, known faults, what is included and the price. Do not claim that a product, a machine, electrical work or a completed installation is approved, certified or compliant unless you hold current evidence covering it. Anyone advertising work carries every registration, licence, permit, insurance and safety duty that work requires. We may pull a listing down or ask you to produce the evidence behind it.

Plans, boosts and payments to us

Free Private includes up to five active ads. Private Seller Plus is A$14.95 per month including GST for up to 25 active ads and the stated private-seller tools. Business seller accounts are unlimited and free at launch. A featured boost is A$9.95 for 30 days. There is no paid repost product. A paid benefit starts only after Stripe confirms successful payment. If Plus renewal fails, paid capacity and tools pause; a failed boost payment never starts or extends a boost. Refund rights under Australian Consumer Law remain.

Buyer and seller rights

Australian Consumer Law lands differently on a trade sale and on someone selling a spare load of pavers off their own job. A business seller must not mislead a buyer and may owe consumer guarantees; a one-off private sale usually carries few of them, though title, undisturbed possession and freedom from hidden debts still apply. Nothing written here strips out a right the law says cannot be stripped out.

Acceptable use

Do not list unlawful, stolen, counterfeit, recalled or prohibited items; mislead users; harvest personal details; interfere with the service; or use messages for anything unrelated to a genuine marketplace enquiry. The listing rules draw the line on unsafe parts, asbestos-era panels and remote-cloning devices.

Optional marketing

Marketing is not required to use the marketplace. At listing time you may separately opt in to relevant Landscaping Marketplace and NearMe Ads network marketing by email and/or SMS. Service and account messages are not marketing. You can withdraw either consent from Account preferences; a network opt-out always takes priority.

Your content

You own the photos and text you post and license us to display them to run and promote the marketplace. Only post content you have the right to use.

Liability

Nothing here excludes Australian Consumer Law rights. Past what the law requires of us, the platform is provided as is, and we are not answerable for what a buyer or seller does, for a part, a fitting job, a service, a message or a deal done directly between the two of them.
